Terms of Use
for the GonguZen mobile application

These Terms of Use ("Terms") govern your use of the GonguZen mobile application ("the App") operated by Sommer Media s.r.o., Oldřichovice 738, 739 61 Třinec, Czech Republic, IČO: 27760766. By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, in accordance with the Apple App Store / Google Play terms and these Terms.
Premium subscription and purchases
GonguZen is free to download and includes core features at no cost. Optional paid Premium unlocks additional content (premium ambient sounds, visual scenes, Apple Health writing).
Available Premium options:
- Premium Yearly: USD 9.99 per year (or local equivalent), auto-renewing subscription.
- Premium Lifetime: USD 19.99 one-time purchase, no recurring charges.
Auto-renewal terms (Yearly only)
Payment is charged to your Apple ID or Google account at the start of each renewal period. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel your subscription in App Store Settings or Google Play Subscriptions. Cancellation takes effect at the end of the current paid period; access remains active until then.
Refunds
All purchases are processed by Apple App Store or Google Play. Refunds are handled according to the policies of those platforms. We have no direct control over refunds.
Family Sharing
Both Premium Yearly and Premium Lifetime support Family Sharing where the platform allows it.
User conduct
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App for any unlawful purpose
- Bypass technical limitations or paywalls
- Submit feedback containing unlawful, harmful, or harassing content
Intellectual property
All content in the App - including audio recordings, visual scenes, graphics, animations, and the GonguZen name and logo - is owned by Sommer Media s.r.o. or licensed to us, and is protected by copyright and other intellectual property laws. You may not copy, modify, redistribute, or use App content outside the App.
Disclaimer
GonguZen is a meditation timer for general well-being and is not a medical device. The App does not provide medical, psychological, or therapeutic advice. If you have a medical condition, please consult a qualified healthcare professional. The App is provided "as is" without warranties of any kind, express or implied.
Limitation of liability
To the maximum extent permitted by law, Sommer Media s.r.o. is not liable for any indirect, incidental, consequential, or special damages arising from your use of the App. Our total liability is limited to the amount you paid for Premium in the 12 months preceding the claim.
Termination
We may terminate or suspend your access to the App at any time for breach of these Terms or for legal reasons. You may stop using the App at any time by uninstalling it.
Governing law
These Terms are governed by the laws of the Czech Republic. Disputes shall be resolved by the competent courts of the Czech Republic, without prejudice to mandatory consumer protection provisions of the country where you reside.
Changes to these terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent version. Continued use of the App after changes constitutes acceptance of the updated Terms.
